GC Hiring Tip #11: Compensation Expectations    Is your comp competitive? -Some companies use compensation consultants to gauge where their packages should be. -Your recruiter of choice can also be a great resource of real time compensation information. What does GC comp look like? -GC candidates will be looking for a package consisting of base, bonus and long term incentives/equity. -Candidates can often be flexible with how the package is broken down. -Compensation varies greatly depending on industry, public/private, scope of the role and location. -i.e.) Private equity owned companies will offer less in cash (base/bonus) but the equity upside is usually significant. -i.e.) At publicly traded companies, the more senior a GC is, the more significant the equity. CAUTION: Beware of Pay Transparency and Salary History Ban Laws   -Companies should consult their legal counsel regarding the Pay Transparency Laws that have gone into effect in various jurisdictions requiring employers to disclose compensation ranges and oftentimes, other benefits when posting job opportunities. -Similarly, counsel should be consulted regarding the Salary History Bans in various jurisdictions that prohibit employers and their vendors from asking a candidate to disclose their current compensation. GC Hiring Tip #10: Will your GC be In Person, Remote or Hybrid?   Work location is a hot topic of debate these days.    Post pandemic, most of our clients are moving to a hybrid work schedule with two to three days a week in the office.    For most GC roles, the location will depend on the company’s culture and where the teams are located. For example:   -If the company has more of an “in-office” culture with executive leadership and the legal team in the same location, the GC will be expected to be there as well.     -If the leadership team is remote and/or the legal team scattered, companies are more open to a remote arrangement with travel as needed.    CAUTION:   Despite it currently being an employer driven job market, candidates are still holding firm on hybrid or remote work.    Many candidates are unwilling to relocate. Even in a Fortune 100 GC search, candidates were still not interested in relocating.   The more flexible you can be on location, the wider your candidate pool will be.   Where should your GC be located? Reach out with questions.

Attention recruiters and staffing professionals! 🚨 The FTC's new rule on noncompete clauses is stirring the pot and could lead to some significant changes in our industry. Big news: there's a bit of controversy around the FTC's model notice language. 📝 Some insight: although the FTC has offered a model notice with a so-called "safe harbor" for employers, it could be a wolf in sheep's clothing. Why? The language overreaches, suggesting noncompetes are outright "unlawful" post-effective date. But the truth is, this might not hold water if Congress or courts decide otherwise. 🚦 It's like settling for a quick fix that might save time now but could create legal headaches down the line. The FTC can influence, sure, but they don't make the call on what's lawful on their own. 🏛️ For those dealing with in-term noncompetes, the model notice blurs the lines. It doesn't distinguish between restrictions during and after employment, potentially leaving businesses vulnerable if an employee decides to join the competition while still under your roof. 🤔 This could be a real game-changer for many out there, especially given the rule's intended start date of September 4th. However, with the rule still under legal scrutiny, who knows how many delays we'll face before the endgame is clear? ⚖️ Bottom line: tread carefully, folks. Consult legal counsel and keep a keen eye on this unfolding story to ensure your staffing strategies stay on the right side of this evolving rule. The Federal Trade Commission (FTC) recently issued a new rule on April 23, which bans non-compete clauses for workers across all industries, with only a few exceptions. This new rule will prohibit most employee non-compete agreements with retroactive effect, except for the existing non-compete provisions. Furthermore, the rule also requires employers to notify their workers, including former employees, that the non-compete clauses are no longer in effect. As someone who has written extensively on this subject, I am thrilled to see noncompete clauses disappear. Do you have a viewpoint on this? #noncompete #executivesearch

I frequently work with candidates who have noncompete agreements with their current employer. Understandably, many don’t know if, when or where they apply. The recent FTC ruling made a lot of employees think noncompetes are no longer allowed. Two lawsuits are currently underway in federal courts challenging the FTC, and this question will quite possibly make its way to the SCOTUS based on the recent Chevron ruling limiting federal agencies’ power. If you have a noncompete and are considering a job change you need to know what your state law allows. Only 4 states have full bans on noncompete agreements. 9 states and D.C. have restrictions based on employees’ income level. 25 states have other restrictions and 12 states have no restrictions.
