On June 5, 2024, Connecticut followed a number of other states by passing a “decanting” statute which specifically authorizes decanting of irrevocable trusts in Connecticut. Decanting is the act of a Trustee distributing the assets from a trust (“Old Trust”) into a new trust (“New Trust”) which has different terms that are more suited to the current circumstances. While practitioners in Connecticut have been able to decant some trusts in Connecticut before now, this statute, which specifically authorizes Trustees to take this action, will allow Trustees to act with clarity and certainty as well as permit decanting under a broader range of circumstances. “Errors in Weinstein Prosecution Lead to Retrial” Written by Matt Perez https://lnkd.in/emFGKWig The New York Court of Appeals overturned Harvey Weinstein's 2020 felony sex crime convictions due to prosecutorial errors regarding Molineux witnesses. The court determined that this error not only calls for a retrial, but also called into question the broader prosecutorial strategy. Dissenting judges criticized the majority for potentially hindering prosecution of sexually violent criminals by effectively stripping prosecutors of crucial evidentiary tools. On Friday, April 19th, the Council’s Committee on Governmental Operations, State and Federal Legislation will hold an oversight hearing examining the City's Lobbying Laws and Reform. The Committee will also consider three bills that are aimed at reforming NYC's lobbying laws. Research for this hearing required a deep dive into New York City's efforts to increase transparency in government through the enactment of lobbying laws and reforms. I look forward to hearing from the Conflicts of Interest Board, the City Clerk, and the Campaign Finance Board on their efforts to execute the laws that are in place and their thoughts on the proposed bills. I am also looking forward to hearing the thoughts of good government groups, advocates, and the public on the most recent Lobbying Report published by the Clerk. As required by Rhode Island General Laws § 8-16.1-4(b), the JNC has provided its 2023 report to the General Assembly and Governor McKee. Pursuant to the aforementioned statute, the JNC is required to collect demographic information concerning race, ethnicity, and gender anonymously and applicants are not required to provide demographic information. Because there is no requirement that applicants provide the requested information and because the data must be collected anonymously, not all applicants provide the requested information through the JNC’s Voluntary Supplement to the Personal Data Questionnaire. Thus, the information in the report reflects demographic information received from a small sample of the applicants for any given judicial vacancy, and it is biased in favor of those who voluntarily participated. Providing demographic information should be voluntary on the part of applicants. However, the JNC would be able to provide more accurate demographic information about applicants for judicial vacancies if it were not required to collect the data anonymously.

This pivotal ruling reaffirms the delicate balance between protecting the integrity of the judicial process and upholding the fundamental rights guaranteed by the Constitution.
