In April, the Eastern District of Texas considered whether an #arbitration agreement’s carve-out for equitable claims meant certain #ERISA claims were not arbitrable, and the Western District of Louisiana invited the Louisiana Supreme Court to respond to certified questions related to the arbitration of insurance coverage claims. "Seaman" is obviously not such a cool word as "wharfinger" but who is and is not a seaman (and therefore what rights and remedies are available) is still being fought over. The Fifth Circuit provides the latest word in this recent case. Here's my update.

Louisiana addresses Tyler v. Hennepin County | By NTLA State Action Group Leader Stephen Morel of JurisDeed In Louisiana, two competing bills are attempting to overhaul the State’s tax sale system. Both advocate for changing from a bid-down ownership lien auction to a bid-up premium, and a subsequent post-redemptive period, judicial lien-foreclosure process similar to Florida’s, and a processes that preserves surplus equity and homeowner rights to recover it, within limits.   However, a notable distinction of Senate Bill 505, championed by the Louisiana Land Title Association, and currently the leading version in the Senate, proposes a floating redemption period ending, similar to what’s used for mortgage foreclosures where the end is triggered by the earlier to occur of the filing of an action by the foreclosing lienholder after a different minimum passage of time or some much longer period (essentially a statute of limitations to foreclose), but also where, notwithstanding, the debtor can stop foreclosure with full payoff made a moment before the gavel drops to conclude the auction sale of the property. Details on this bill can be found here (https://lnkd.in/erPbR7mY), and it is scheduled for a hearing before the Ways and Means Committee today, with the lobbyist-supported U.S. Assets group planning to oppose it.    On the other hand, House Bill 871, sponsored by U.S. Assets and prevailing in the House, advocates for far fewer changes to the current system, leaning on time-tested, judiciary-approved elements such as the adequacy of private, notification efforts to terminate rights of interest-holders (in force since 2009), and having a strict duration for redemption, after which anyone seeking a redemption would need to bid at the deed auction to do so. Here it comes. . . . At a recent Energy Seminar hosted by GableGotwals, we discussed the impact on the oil and gas industry of the United States Supreme Court decision in Helix Energy Solutions v. Hewitt: day rate workers, even highly compensated ones, may still be entitled to overtime. Understand the plaintiffs' bar: they smell blood in the water. A flood of overtime lawsuits for oilfield workers is coming. This new one is just among the first. The claims? 👉 Oilfield Worker AA was paid hourly and often worked more than 40 hours per week, but his compensable time was not calculated correctly, so he was not paid overtime. He and all those employees similarly situated are entitled to overtime for the past three years, plus liquidated damages, plus attorneys fees. 👉 Oilfield Worker BB was paid a salary and usually worked more than 40 hours per week, but he was misclassified as exempt when he shouldn't have been, so he and all those employees similarly situated are entitled to overtime for the past three years, plus liquidated damages, plus attorneys fees. 👉 Oilfield Worker CC was paid a day rate and usually worked more than 40 hours per week, but was not exempt and was not paid overtime. He and all those employees similarly situated are entitled to overtime for the past three years, plus liquidated damages, plus attorneys fees. It adds up quickly. These are expensive cases. What can you do? Before litigation: 🕛 Audit your pay practices and classifications. Fix the errors and close the gaps. To do this, consult with counsel who understands both employment law and the oil and gas industry. 🕜 Execute arbitration agreements with your employees (and also require your contractors who present the greatest overtime risk to execute arbitration agreements with their employees with customers as third-party beneficiaries) to reduce your class action risk. 🕒 Train your managers and HR personnel on overtime issues specific to your industry, such as what field time is compensable versus preparatory or "break time." When litigation arises, hire defense counsel who understands both your industry and employment law. Experienced, knowledgeable counsel can help defend exemptions and limit the scope of what the plaintiffs argue is a "similarly situated" collective action. #oilfieldovertimedefense
