GSA Schedule Holders - Don't Miss This!! GSA is planning to release Refresh 22 to its MAS Solicitation 47QSMD20R0001 and an associated mass mod for existing schedule holders in August 2024. GSA will hold a webinar on Monday, July 22, 2024 at 1pm ET. Make sure you understand what that means to you should you select to participate. Learn more about TDR at https://lnkd.in/g-h8Yn9A The refresh also adds a statement to FAR Clause 52.232-36 under GSAR/M clause SCP-FSS-001 regarding payments made by the Governmentwide Purchase Card (GPC) and related processing fees, that reads: "Proposed prices must be inclusive of all costs associated with acceptance of the Governmentwide commercial purchase card (e.g., payment processing fees). Schedule contractors may not impose a surcharge at the order level for payment by Governmentwide commercial purchase card." This is important so you can recoup processing fees as the Government pushes to expand its use of the GPC into contract payments. Sell software on GSA Schedules? GSAM/R clause I-FSS-600 will be modified to add that MAS contractors MAY indicate if a software producer has attested that software complies with Government-specified secure software development practices and has an attestation form uploaded to the CISA repository by adding language provided in the Refresh under bullet 18b, Terms and Conditions, in their text file. DFARS Case 2024-D004, Pilot Program To Incentivize Contracting With Employee-Owned Businesses was published as a proposed rule today (5/30/2024). The purpose of the proposed rule is to implement sections of the NDAA for FY22 and FY24 that authorize DoD to establish a pilot program that allows for the noncompetitive award of certain follow-on contracts to certain employee-owned businesses. This rule would-- ▶️ Add new DFARS part 270, Defense Contracting Programs ▶️ Add new subpart 270.X, Pilot Program to Incentivize Contracting with Employee-Owned Businesses ▶️ Authorize Contracting Officers (KOs) to award one sole-source, follow-on contract for the continued development, production, or provision of products or services that are the same or substantially similar to those procured under previous contracts awarded by or for DoD to contractors that are a "qualified business". ▶️ Defines a "qualified business" as an S corporation (defined in 26 U.S.C. 1361(a)(1)) for which 100 percent of the outstanding stock is held through an employee stock ownership plan (defined in 26 U.S.C. 4975(e)(7)). ▶️ Add two proposed solicitation provisions that would require offerors to represent that they are a qualified business and they will comply with the limitations on subcontracting. ▶️ Add a proposed contract clause that would require contractors to comply with the limitations on subcontracting as well as reporting requirements due within 30 days after the end of the contract. ▶️ Stipulates the authority to award contracts under the pilot program would expire on 12/27/2029. Limitations are-- ▶️ Only a KO may submit an application to participate in the pilot program; ▶️ KOs may only award contracts to contractors that meet the definition of a qualified business; ▶️ KOs may only award one sole-source, follow-on contract to a qualified business for each predecessor contract, unless a waiver is obtained; and ▶️ Unless waived, a qualified business shall not pay more than 50% of the amount paid by the Government for contract performance to subcontractors that are not qualified businesses, except when the contract is for a product and subcontracts for materials are not available from another qualified businesses. The proposed rule would not be applicable under the Simplified Acquisition Threshold (SAT) but would be applicable to the acquisition of commercial products (excluding COTS items) and commercial services under FAR Part 12. 🔽 See DoD's input request below 🔽 Time for some of those great ideas batted around on LinkedIn to reach the right people in DoD, particularly how to reach small businesses and non-traditional defense contractors and bring them into the fold early in the design, development, and testing processes. The DoD needs DIB expansion. AI, like it or not, is the next big initiative for DoD and most Federal agencies. DoD needs help to make it happen and leveraging AI is going to be an avenue to get it done.

Government Contracting #govcon seems to be a labyrinth 😕to many outsiders and newer folks coming into the space. I once created an Access database🧮 at a previous employer many years ago to highlight the importance of good data management and common unique identifiers... As the company tended to have some byzantine processes and nomenclature that I was trying to flesh out and focus 🔍on measuring the things that matter. So I've seen quite a bit of diverse contracts from over $100M 💰annual jobs to ones under $100K. I believe the process is essentially the same to ensure a smooth transition from pre-award to 🥇post-award. It starts with being able to accurately code 🔣your contract into your system of record. Do your #proposal 📚and #pricing 💵documents match the contract award 📝documents? Check that before you 🖋sign! Had an experience recently where there was some ambiguity 😵with a contract modification document in what it was doing as it relates to the changes we proposed. Some contracts get complex when you get to a dozen mods or so with many CLINs, SLINs, and 🗜ARCNs... IYKYK We both had differing interpretations🗣 as we worked through the document. There was a 💪🏼challenge with all the moving parts and new CLINs added and old ones removed and it turns out that we both had the same initial confusion that it wasn't done correctly... However, when we dug ⛏deeper into the changes in Section B (contract values) and Section G (funding values) we determined that this customer was doing It's important to have a uniform 🥋methodology on how you read and review your contract documents before you sign it and book the funding and contract values in your accounting system. Set your books up right the first time, or you'll pay💸 for it over-and-over again each month. And get the right people 🤼 and departments involved! Make it a great week 👊🏼

Over the past 2 months we have seen the DoD move toward the adoption of the Cybersecurity Framework (CSF) for the Defense Industry Base, as part of the DoD DIB cyber strategy, and clearer oversight of their implementation of the Risk Management Framework (RMF), DoDi 8510.01 and DoDi 5000.90. As cyber regulation in the U.S and EU aligns around cybersecurity risk management, the U.S National and international DIB will be affected by both the focus the DoD is placing on the CSF and RMF for the management of cybersecurity based upon risk. Thaddeus Dziekanowski and Brian D. McCarthy the DoD, DIB and the boards of covered entities require a greater understanding of the RMF (NIST SP 800-37), FISMA, the CSF 2.0 and associated DoDIs.
