PHADA comments on Build America, Buy America (BABA) Request for Information urges U.S. Department of Housing and Urban Development to take additional time to plan for BABA, including more detailed guidance, additional resources and training, and a streamlined waiver process to ensure a smooth transition for HUD and housing partners. While a worthy goal, BABA implementation risks delayed or jeopardized affordable housing projects due to ongoing concerns related to increased costs, as well as continued unanswered questions. As we consider the current administration’s proposal to implement a rent control mechanism, capping rents at 5% for owners of 50 or more units, it is crucial not to lose sight of the many other challenges contributing to the growing affordability crisis. There has been no shortage of criticism on this plan on LinkedIn, grounded in years of well-founded research and opinions from numerous housing experts across the nation. Almost unanimously, the consensus is that imposing national rent control will exacerbate existing housing shortages—now averaging 1.5 million units nationwide—and increase, rather than decrease, affordability. I encourage you to read the attached article from the National Association of Home Builders (NAHB), which offers a ten-point guide as a blueprint towards equitable housing. Pay special attention to points #1, #5, #6, and #8. While every point on the NAHB’s guide is significant, those I highlight have been responsible for adding over 40% to multifamily development and over 20% to single-family development in regulatory costs alone. In Puerto Rico, these costs are even higher, further complicated by grossly inequitable fair market rents that are unsustainable at any level. Rent cap legislation was also introduced fairly recently, ignoring the massive disfunction in permitting, land-use restrictions, approvals and archaic zoning statutes, amongst others. This isn’t rocket science; it’s a matter of supply and demand. The Council's State of the Housing System 2024 outlines 10 areas for improving the housing system, including social housing investment and addressing regional-specific challenges. 3. Planning efficiency, land release, and infrastructure are key factors in increasing housing supply. 4. Purpose-built student accommodation, retirement living communities, and build-to-rent housing are seen as solutions to the housing shortage. 5. Since 1974, the U.S. Department of Housing and Urban Development (HUD) has played a pivotal role in shaping the evolution of affordable housing. 2024 marks the 50th anniversary of the passage of the National Manufactured Housing Construction and Safety Standards Act, or the HUD Code, and the rise of modern manufactured housing. Enacted in 1974, the National Manufactured Housing Construction and Safety Standards Act authorized HUD to create a uniform national building code for manufactured homes, standardizing safety and construction standards across states. This legislation and an ongoing partnership with the Manufactured Housing Institute were crucial in improving the quality, safety and livability of manufactured homes. The Rent Guy
The U.S. Department of Housing and Urban Development (HUD) is taking action to improve living conditions for low-income families. HUD recently announced $90 million in grants to make homes healthier and safer through its Healthy Homes Production Grant Program. This funding will assist nonprofits, for-profit firms, state and local governments in identifying and remediating housing-related health and safety hazards like lead-based paint, mold, carbon monoxide, and fire hazards in low-income housing. By addressing these issues, HUD aims to reduce the number of housing-related injuries and illnesses among vulnerable populations, especially children. This investment underscores HUD's commitment to creating a decent, safe, and sanitary living environment for all. As professionals in housing and community development, we should applaud initiatives that prioritize the well-being of underserved communities.
