The authors advise that “immediate efforts … should focus on containing and responding to the security incident. At the same time companies cannot lose sight of potential long-term repercussions, including those related to litigation. While it is impossible to prevent a litigation adversary from second-guessing preservation efforts, early consideration of preservation and the implementation of a measured and reasonable approach to this duty serve to greatly enhance defensibility of process and reduce the potential for claims of spoliation in the event of litigation.
