Employment win! Partner Jeff Williams and associate Brandon Parrish recently notched a complete victory at arbitration in an employment discrimination and retaliation case. Following a week-long hearing that featured testimony from more than ten witnesses (including three experts), the claimant sought an award of over $2 million plus punitive damages against her former employer. The arbitrator ruled in the employer's favor on every single cause of action and awarded nothing to the claimant. Wargo French Singer is proud to have successfully defended its client in this matter. #employment #litigation #arbitration

Congratulations to partner David Pernini, who has been invited to speak at the National Association of Broadcasters (NAB) Show in Las Vegas on April 16, 2024. The show is the premier event for the NAB, the main advocacy association representing the interests of commercial and non-commercial over-the-air radio and television broadcasters in the United States. The NAB represents more than 8,300 terrestrial radio and television stations as well as broadcast networks in the United States.    David will be giving a presentation entitled “What Does Non-Compete Mean with Terrestrial vs Digital Radio.” David has been handling contract disputes (including non-competes) in the broadcast industry since at least 2005, and has been lead trial counsel for numerous multi-million dollar jury trials.  Just last year he successfully defended a company in a jury trial related to non-compete agreements.      Hope to see everyone at the show! https://nabshow.com/2024/

Wargo French Singer is pleased to announce that Blake Mansker has joined the Firm as an associate in its Miami office. Blake’s practice focuses on commercial litigation disputes and insurance coverage.     Blake is an experienced litigator who has represented insurance carriers and their insureds as well as self-insured companies in actions alleging negligence, vicarious liability, premises liability, wrongful termination, and discrimination. Most recently, he obtained a favorable final compensation order on behalf of a major airline company in which the judge of compensation claims dismissed all of claimant’s claims with prejudice. Victory in Hawaii! Partner David Pernini and associate Tyler Dysart obtained summary judgment in a case filed on behalf of our client in the District of Hawaii. The dispute arose when our client's landlord refused to honor a right of first refusal in its commercial lease, arguing that the supposedly "non-binding" nature of the letter of intent it had received did not trigger the right. David and Tyler filed suit and moved for early summary judgment, which was opposed by the landlord on both factual and procedural grounds. While this was a case of first impression in Hawaii, we are happy to report that the Court agreed with our client's position in full, entering a judgment for specific performance of the right of first refusal (and thus the sale of the property to our client), damages in the form of continued rent payments to the landlord since the breach, and prevailing-party attorneys’ fees.  The time from filing of the lawsuit to grant of the order for summary judgment was less than 8 months. #win #summaryjudgment #litigation
