Read FPF’s statement on the revised American Privacy Rights Act (#APRA) by CEO Jules Polonetsky: “Civil rights protections are essential to any comprehensive federal privacy law. We must ensure that all people, regardless of race, gender, age, or other protected characteristics, are treated fairly when their personal data is processed. Removing digital civil rights provisions from a preemptive federal proposal like the American Privacy Rights Act is incongruent with the direction of data privacy in the U.S and globally, and would weaken existing rights under current state privacy laws. Individuals and organizations deserve a clear articulation of their rights and responsibilities when it comes to combating data-driven discrimination. Privacy is a civil right. Recognition of civil rights in federal law is a goal that responsible businesses and civil society can both support.”

These include areas lacking core obligations and rights that the majority of state comprehensive privacy laws have, enforcing higher fines than other comparable laws, and having a unique, prescriptive privacy notice obligation.
