Em outubro de 2023, o fundador e CEO da TalentoTotal, Gem McCreary, tornou-se um "Whistleblower" e buscou relatar possíveis fraudes, abusos e lavagem de dinheiro relacionados a uma doação significativa que a TalentoTotal recebeu do Fundo ESG da Oferta Pública Inicial (IPO) do Nubank ao U.S. Securities and Exchange Commission (SEC), ao U.S. Commodity Futures Trading Commission (CFTC), ao Federal Bureau of Investigation (FBI), U.S. Department of Justice (DOJ), e ao U.S. Attorney's Office for the Southern District of New York (SDNY). Cinco meses depois (março de 2024), a TalentoTotal recebeu uma notificação de que sua subsidiária, "TalentoTotal Brasil", estava sendo processada pelo Nubank por intermédio de seu mandatário (Sitawi Finanças do Bem) em uma tentativa de recuperar os fundos ESG do IPO que foram doados à TalentoTotal para apoiar a capacitação da equipe e aumentar o número de candidatos que a TalentoTotal apoia por meio do TalentoTotal GMAT e TOEFL Boot Camps. Nos últimos meses, a TalentoTotal, uma pequena organização sem fins lucrativos com três funcionários em tempo integral, dedicou uma quantidade insustentável de nossos recursos financeiros, de tempo e energia para defender a organização de uma empresa de capital aberto, o Nubank (NYSE: NU), com uma capitalização de mercado de quase US$ 60 bilhões. Além disso, a TalentoTotal enfrentou táticas de intimidação, incluindo, mas não se limitando à divulgação de informações pessoais, como o endereço residencial dos funcionários da TalentoTotal. Apesar de ter sido secretamente alvo do Nubank por mais de um ano devido a uma cláusula de confidencialidade imposta pelo Nubank no acordo contratual inicial (2022), a TalentoTotal ainda conseguiu resistir a um ataque da empresa com 7.000 funcionários e produzir resultados históricos em 2024.
