As of August 5, 2024, the City of Philadelphia's Office of Property Assessment (OPA) has completed a revaluation of all properties in the city for the 2025 tax year. Assessments for 2025 taxes will be sent out within the next few days. The city's delay in issuing reassessment notices has made it important to proactively manage property taxes. Reviewing assessments early and considering an appeal can help ensure tax liabilities are fair and in line with market conditions. Commercial property owners may want to consider filing appeals due to declining market conditions, which could lead to significant tax savings. RCCB Litigation and Real Estate Partner S. David Fineman has successfully represented some of the largest commercial real estate owners before the Board of Revision of Taxes in Philadelphia and the surrounding counties, achieving significant tax reductions. If you believe your assessment is too high, an appeal might be warranted if your assessment is higher than the actual property value or not uniform with other properties. Reduced taxes can mean significant savings, including lower real estate and use and occupancy taxes. The deadline for filing a tax appeal in Philadelphia is the first Monday in October. For a 2025 assessment, appeals must be filed by October 7, 2024. Plan and file early to avoid last-minute issues. For guidance, reach out to S. David Fineman and take control of your commercial property tax assessments. Contact info: https://bit.ly/3WSf3Q4 #RealEstate #TaxAppeal #CommercialProperty

A federal judge in Pennsylvania recently declined to enter an injunction against the Federal Trade Commission’s (“FTC”) final rule banning employment non-compete agreements (“final rule”). In substance, the final rule bans all non-compete agreements with very limited exception. The decision comes on the heels of a Texas federal court decision, which, unlike the Pennsylvania decision, granted a limited preliminary injunction against enforcement of the final rule applicable only to the moving plaintiff and confined to Texas, i.e., the Texas federal court declined to enter a nationwide injunction. At the start of this month, FINRA ordered Merrill Lynch to return nearly $1.5 million to its customers. Why? Merrill reps recommended products in brokerage accounts instead of advisory accounts, missing out on fee waivers for 2000 accounts. Merrill’s failure to set up a proper supervisory system led to unsuitable recommendations, harming clients and violating both FINRA’s Rule 2111 and Reg BI. This isn't just a lesson for Merrill. It’s a wake-up call for many of us in the financial industry. For those of us who are fiduciaries, we must ensure our clients' interests come first. That means robust systems for assessing suitability and thorough checks throughout our compliance programs. Need help ensuring your compliance policies and procedures are rock solid? We're here to assist. Reach out to us today! Learn more: https://bit.ly/4cKfqBB #FINRA #Complianceprogram #Fiduciaries

The Supreme Court of Pennsylvania Will Take Up Question of What Constitutes “Skill” Gaming." The Supreme Court of Pennsylvania is set to address what really constitutes 'skill' gaming. Are they skill games or just another form of slot machines? Pennsylvania's highest court will decide whether the cash-paying electronic game terminals that are commonplace in convenience stores, bars and elsewhere are unlicensed gambling machines. Discover the implications for Pennsylvania and beyond, as nearly 70,000 of these machines are in question.
