Take a look at friend of the firm, Elliot Sloane’s, important post. The struggle is real. Boutique businesses often have no leg to stand on and rely on clients to be honorable. His perseverance and result is inspirational. Score one for small business.
With some guardrails on what I can say due to a non-disparagement clause -- I wanted to share a short note to say that for all of us smaller business owners/ boutique consultants out there who do great work and on that rare occasion run into a client who simply refuses to pay and dares you to sue -- thinking that they can bleed you dry - all is not lost. It took two years, a Federal lawsuit (withdrawn due to some venue issue), a NYS lawsuit (which we won when the client couldn't be bothered to mount a defense), months and months of delay tactics, five different incompetent lawyers, a refusal to honor an information subpoena, and finally, a NYS contempt ruling that forced the client to pay $1500 a day in penalties and cover some portion of our legal fees to get these guys to settle and pay us what they originally owed us (plus all our legal fees.) Two years to get to the place where we started. I know sometimes we tell ourselves that not being paid on occasion is part of doing business. Maybe. But I have to say that it was supremely satisfying to see the legal system work and for the world to be made right in this small way. There is "the right way" and the "wrong way." And to know that courts care about plaintiffs in these actions. And that having a great lawyer really matters.

A great article in FastCompany authored by Patrick Hussey coins the phrase “competitive AI (CAI),” where AI models are taught to compete with other models on various battlegrounds—finance, law, reputation, and risk. "The possibility of CAI becoming a weapon in reputation battles seems an inevitable development in a society addicted to culture wars. Startups like Signal AI will form the defense..." As Patrick points out, our proprietary technology is built to defend enterprise risk and reputation. It's a tool for CCOs, CMOs, heads of strategy, and, more frequently, general counsels and compliance officers to give them an edge in the reputation battleground.
