🚨 NABIP Responds to Proposed Insurance Fraud Accountability Act 🚨 NABIP CEO Jessica Brooks Woods CEO, MPM, PHR issued the following statement today on the proposed Insurance Fraud Accountability Act, introduced by Senate Finance Committee Chair Ron Wyden and five other senators. This bill aims to address criminal activity in the federally facilitated ACA Marketplace and strengthen consumer protections. Jessica Brooks-Woods states, "NABIP is dedicated to upholding and enhancing consumer protections. The negative portrayal of the entire profession is both unfair and misleading, as the exposure of fraudulent enrollments was due to vulnerabilities in the Federal Marketplace. To date, we have not received any updates regarding law enforcement action against this sophisticated criminal activity, which harmed both healthcare consumers and the agents who enrolled them." 🚨 Important Update for Medicare Advantage Agents and Brokers! 🚨 A Texas district court recently issued a stay on portions of the Contract Year (CY) 2025 Medicare Advantage Final Rule. This ruling impacts how independent agents and brokers are compensated for MA enrollments. As a result, CMS is reverting to the CY2024 compensation rates for CY2025, with the administrative payment adjustment removed. The updated CY2025 fair market value (FMV) amounts reflect this change. 📢 CMS Takes Action to Prevent Unauthorized Agent and Broker Marketplace Activity 📢 Starting today, the Centers for Medicare & Medicaid Services (CMS) will implement new measures to prevent unauthorized changes in consumers’ Federally-facilitated Marketplace (FFM) enrollments by agents and brokers. Key Updates: 📋 Agents/brokers must be associated with a consumer’s enrollment to make changes. 📞 New agents/brokers must use a three-way call with the consumer and Marketplace Call Center or direct consumers to make changes themselves via HealthCare.gov or approved partners. CMS anticipates these updates will help block unauthorized changes by agents and brokers to FFM enrollments. CMS will continue to monitor any malicious activity by agents or brokers on the Marketplace and will take additional appropriate action against agents and brokers engaged in misconduct. We commend CMS for addressing this unethical behavior. This decision aligns with NABIP's Healthcare Bill of Rights, which aims to protect consumers and improve the healthcare delivery system for all Americans.
