California’s Civil Rights Department is flexing its muscles – the CRD has reported that Microsoft will pay more than $14 million and implement specific reforms in order to resolve claims that it mistreated employees who took protected leave. The agency accused the company of retaliating against such workers by giving them less favorable performance reviews and lower compensation after they returned from leave. A growing number of states and municipalities across the US have adopted “fair work week” rules for shift workers. These ordinances typically mandate predictable scheduling, compensation for last-minute changes, and adequate rest periods between shifts. Some require that businesses offer additional hours to existing employees before hiring new staff. With the stroke of a pen, Governor Newsom could grant employers long-awaited relief from some of the most onerous provisions of California’s Private Attorneys General Act. The state’s legislature has passed two measures that would ratify negotiated reforms of PAGA. If (as expected) the Governor approves the bills, a ballot measure to repeal and replace PAGA would be withdrawn.
