About us

Molly Schultz Hafid is the Executive Director of the Butler Family Fund, a family foundation whose mission is to seek lasting solutions to homelessness and an equitable criminal legal system. She also manages a consulting practice (MSH Consultants) rooted in her personal and professional commitment to social justice. Molly works closely with individual donors and family foundations, providing strategic guidance on expanding grantmaking programs, developing participatory grantmaking models, governance assessment and redesign, and organizational development. A sector leader contributing strategic guidance and thought leadership in social justice philanthropy; Molly received the Neighborhood Funders Group Award for Excellence in Philanthropy in 2018. She is a co-founder of Funders for Justice and served as the co-chair until the end of 2021. Molly currently serves as the Treasurer of the Board of Directors of the National Committee for Responsive Philanthropy (NCRP) which promotes accountability and the highest standards of integrity and openness within the sector. She is also the Chair of the Board of Just Fund, the only nonprofit grantmaking solution created by funders and organizers of color. Molly is currently a 2021 Aspen Institute and Neighborhood Funders Group Philanthropy Forward Fellow. She has a Master of Public Administration specializing in International Nonprofit Management from New York University's Robert F. Wagner Graduate School of Public Service and a bachelor's degree in Anthropology and Literature from Antioch College in Ohio. She also holds an executive education certificate in Nonprofit Financial Sustainability from Harvard University's John F. Kennedy School.

Helen Flannery and Chuck Collins at the Institute for Policy Studies have been doing critical investigations on this for a long time, along with academics like Ray Madoff and more than I can link here. It's a growing issue -- and some of the largest foundations in the country are using this loophole.     Did you know that the payout requirement for all private foundations is, effectively, $0? You thought it was a minimum of 5%, right? I did too, for many years. But there is a massive loophole that negates this requirement, that allows any foundation to avoid giving a single, solitary dollar to an operating charity, ever. This loophole allows a private foundation to meet its 5% minimum distribution requirement by giving the entire amount to a Donor-Advised Fund (DAF) that it controls. And DAFs, in turn, have no legal distribution requirement. It is, therefore, only at the discretion of the foundation's board that it engages it any kind of philanthropic activity at all. Any kind of grantmaking. Any use of the corpus for positive social impact, rather than investing it purely for its own perpetual growth. I don't point this out to dump on foundations - or on DAFs. I'm not saying that there are more than maybe a handful that actually do this. (It would be interesting to see actual numbers since the IRS has been collecting this data for years on the 990-PF tax return for private foundations) What I am saying is that in the last decade we have discovered that many things we thought were a matter of legal or contractual requirement turned out to be more like a suggestion, or a norm, or a handshake agreement between people of good faith. We didn't notice before because everyone had been following the norms in good faith. Until some people didn't. And we saw that there are no consequences for people who choose to break that faith. This feels wrong to me. Dollars legally designated for charitable purposes, with attendant tax benefits, should be required to be actually distributed to operating charities within a reasonable timeframe. I cannot come up with a public benefit associated with stockpiling them. It's time to close these loopholes. #philanthropy #socialimpact #privatefoundations #charity
