On July 2, 2024, the Occupational Safety and Health Administration introduced a proposed national heat standard to prevent heat-related workplace injuries.   Employers would be required to implement a Heat Injury and Illness Prevention Plan (HIIPP), providing measures such as cool drinking water, shaded break areas, and paid rest breaks at an 80°F heat index. At a 90°F heat index, additional precautions like pre-shift hazard alerts and frequent rest breaks are mandated.   The proposal also includes appointing heat safety coordinators and establishing emergency response plans. FTC Noncompete Ban Update - The attorneys of Maynard Nexsen’s Employment and Labor group will continue to monitor and post any developments and appeals related to the FTC Noncompete Ban.   On July 3, a U.S. District Court judge issued a limited-scope injunction staying the effective date of the FTC Noncompete Ban and barring its enforcement. This injunction currently applies only to the named parties in the case. Despite the limited scope of the present injunction, the Court’s opinion suggests that it likely ultimately will rule that the FTC exceeded its authority in promulgating the Ban, which in turn would result in the broader invalidation of the Ban pending appeals.
