"Employers’ use of non-compete agreements have been subject to increasing scrutiny from federal agencies in the past year or so. More recently, the balance of discussion surrounding regulatory efforts to curtail the use of non-compete agreements has been focused on the Federal Trade Commission’s final rule banning non-compete agreements. At the same time, the National Labor Relations Board has quietly continued to challenge employee non-compete agreements through enforcement actions. In June, an NLRB administrative law judge (“ALJ”) sided with the Board, ruling that “ridiculously broad” non-solicit and non-compete provisions in an employment agreement were unlawful under federal labor law. Law360 | Kilpatrick has elevated a longtime trademark partner based in Atlanta to lead its global intellectual property department, making her the first woman to lead the IP department. Wab Kadaba, the firm's new chair and former IP lead, told Law360 Pulse on Friday that the firm has named a longtime firm partner, Jennifer Arkowitz, as the firm's global chair of the IP department, which has more than 300 attorneys. "In 1839, Charles Goodyear was on the verge of a momentous discovery. Natural rubber is useful within only a narrow temperature window—it becomes a foul-smelling goo at slightly elevated temperatures and hard and brittle at low temperatures. Chemists in the US and abroad had been searching for decades for a way to solve this problem. Goodyear was obsessed with finding a solution. He tried everything he could think of, frequently working out of his home kitchen. Eventually, he fell on hard times, getting evicted from his home and making several trips to debtors’ prison. In a fortuitous stroke of luck, Goodyear happened to drop a mixture of natural rubber, sulfur, and white lead onto a hot stove. When he picked it up, expecting the rubber to be a molten mess, he found that it was soft and pliable like leather.
