The "three pillars," a set of rules proposed by the Treasury Department for regulating Biden's clean hydrogen tax credits, are crumbling. "The Treasury has been under immense pressure from Congress, energy companies, and even leaders at the Department of Energy to relax the rules since before it even published the proposal in December," Emily Pontecorvo writes. "But lately, the campaign to dismantle the pillars has gotten both more forceful and more threatening." Here's a sneak peek at some of the expert opinions on the tax credits and their effects from the full article below: “They're losing advantage over other parts of the world,” says Hector Ivan Arreola, principal analyst for hydrogen and emerging technologies at Wood Mackenzie, on the clean hydrogen industry in America. “People can always sue today to challenge regulations. It's just that the odds of success have increased,” Keith Martin, a renewable energy tax lawyer at the firm Norton Rose Fulbright says of companies' abilities to sue regulatory agencies following the loss of Chevron deference. “Bottom-line, the effectiveness of green hydrogen as a decarbonization tool is being artificially held back," says Beth Deane, chief legal officer for Electric Hydrogen. "We need to give up perfection on both sides of the three-pillar debate and find the ‘good enough’ solution that lets early mover projects move forward with less stringent requirements." "This effectively unlocks more than 10 million metric tons of dirty electrolytic hydrogen,” Dan Esposito, a manager in the electricity program at the think tank Energy Innovation Policy and Technology LLC says of the emissions consequences of the three pillars' weakening. “We need to deploy this infrastructure,” Paulina Jaramillo, a professor of engineering and public policy at Carnegie Mellon University, says of subsidizing electrolytic hydrogen. “We need to deploy it now so it’s available later.”
