The United States Court of Appeals for the Second Circuit vacated an injunction granted by the district court. The lower court had ordered Citibank, N.A. and Citigroup, Inc. (“Citibank”) to direct its subsidiary in Gabon to maintain a freeze on bank accounts of Cameroon Oil Transportation Company S.A. held at Citibank Gabon pending the outcome of an arbitration before the International Chamber of Commerce. The Second Circuit held that the lower court’s injunction exceeded its jurisdiction because Citibank did not control the accounts at issue, which were held at its separate subsidiary in Gabon and over which the court did not have jurisdiction. The case is a significant win for Citibank because the appellate court made clear that Citibank cannot be held liable for the acts of its subsidiaries based on Citibank’s controlling ownership interest in the subsidiary. sharon schneier argued the appeal, which the Second Circuit agreed to hear on an expedited basis, and Ted Snyder and Gaurav Talwar worked on the case, including the winning briefs.

Our amicus brief on behalf of ten individuals in Portland with disabilities, describing the dangers they face in trying to navigate city streets blocked by tent encampments, was cited twice in the Supreme Court’s recent majority opinion in the Grant’s Pass case. Great work by DWT’s John A. DiLorenzo Jr. and Seth "Moe" Tangman, who successfully represented these same plaintiffs in a lawsuit against the city of Portland.
