Federal patent law allows a patentee to devise its own definition for a claim term — or act as its own “lexicographer” — rather than settling for the “plain and ordinary” meaning. At first glance, this may seem like an advantage for patent holders. Sometimes, though, a patentee can become a lexicographer inadvertently, with disastrous consequences. Read the article, "Patentee’s claim term definition comes back to haunt it," from the Cantor Colburn LLP June/July 2024 IP newsletter. And that's a wrap on RTX Invention Convention U.S. Nationals 2024! We had an absolute blast with our youth inventors and their families at The Henry Ford this week and we are inspired by the incredible creativity, ingenuity and resourcefulness we saw in their inventions. To our inventors, we could not be more proud of you and we hope this experience only fuels your passion for inventing further. Whether you won an award or not, you are all winners just for making it this far and you should all be proud of your accomplishments. Thank you to parents and supporters for encouraging these young minds, to educators for giving them the tools to succeed, to our affiliates for empowering this next generation, to our judges for lending their time and expertise, to our partners for your incredible support without whom this would not be possible, and finally to the staff and volunteers at The Henry Ford, and the ICW team for putting this event together. These youth inventors are inventing our future and we could not be in better hands. Congratulations to all, we hope to see you next year! 𝗪𝗵𝗲𝗻 𝗣𝗮𝗿𝗼𝗱𝗶𝗰 𝗜𝗻𝘁𝗲𝗻𝘁 𝗔𝗳𝗳𝗲𝗰𝘁𝘀 𝗟𝗶𝗸𝗲𝗹𝗶𝗵𝗼𝗼𝗱 𝗼𝗳 𝗖𝗼𝗻𝗳𝘂𝘀𝗶𝗼𝗻 In finding a likelihood of confusion between the parody Wavy Baby and the trademarked Old Skool in 𝘝𝘢𝘯𝘴, 𝘐𝘯𝘤. 𝘷. 𝘔𝘚𝘊𝘏𝘍 𝘗𝘳𝘰𝘥𝘶𝘤𝘵 𝘚𝘵𝘶𝘥𝘪𝘰, 𝘐𝘯𝘤., the U.S. Court of Appeals for the Second Circuit acknowledged that the Wavy Baby was a parody — just not one entitled to the Rogers test. And a parodic expressive message can figure in the assessment of the likelihood of confusion. Citing the U.S. Supreme Court, the appellate court explained that a “successful” parody must create contrasts with its target so the message of ridicule or pointed humor comes through. It must convey that it’s not the original but a parody. If it does so, a parody is unlikely to create confusion. If a parodic use of protected marks leaves confusion about the source of a product, though, it hasn’t succeeded for purposes of trademark law and the infringement is unlawful.
