What should plan sponsors know about the two new exceptions to the SECURE 2.0 Act's 10% additional tax on early distributions? With limited exceptions, distributions from a qualified plan for participants under the age of 59.5 are generally subject to an additional 10% tax. However, the SECURE 2.0 Act of 2022 has introduced new exceptions for emergency personal expenses and victims of domestic abuse, and the IRS has issued guidance on administering them. In their latest First Alert, Calfee's Employee Benefits & Executive Compensation group provides an overview of this guidance and key takeaways for plan sponsors. Are you an employer operating with employees in California? The California Labor Code now mandates that nearly all employers in the state develop a Workplace Violence Prevention Plan (WVPP) and a corresponding training program. With few exceptions, California employers must now adopt and effectuate a WVPP and corresponding record-keeping practices. In this Calfee Connections blog post, Jennifer (Walwyn) Colvin, Senior Counsel in Calfee's Labor and Employment Practice Group, provides more details about this requirement and compliance.
