"No fight for civil liberties ever stays won” – Roger Baldwin, founder of the national ACLU Our Mission: The mission of the ACLU of Delaware is to preserve and advance civil liberties and civil rights in the State of Delaware as enshrined in the United States and Delaware Constitutions through education and advocacy without consideration of political association. The defense of civil liberties knows no political party bounds, which is why the ACLU remains nonpartisan. We have joined in coalitions with conservatives and progressives alike on a wide array of issues—from reforming the intrusive powers of the Patriot Act to blocking infringements upon our First Amendment rights. The ACLU is the premier civil rights organization in our country, earning widespread respect and admiration for its consistent defense of constitutionally based principles. We work in the courts, in the state and federal legislatures, and at the grassroots level to defend the Constitution wherever it is threatened. The ACLU-DE, the local affiliate of the national ACLU, was established in 1961. We are a first resort when the government threatens our rights in Delaware and a last hope when we are deprived of our liberties. ACLU-DE has played an important role in Delaware history, especially in the arena of education: - In 1975, ACLU-DE, under the leadership of Gerry Kandler, prevailed on the State of Delaware to provide children with physical and intellectual handicaps full access to education. These efforts help spur educational equality throughout the country. - ACLU-DE also played a significant role that led to the desegregation of schools in the City of Wilmington in the 1980’s. This action also had an impact on desegregation nationally. - In the 1990’s, the ACLU-DE was instrumental in reforms to the Ferris School for Boys, which is now a national model as a state-of-the-art juvenile secure care facility.

    This year in addition to the Kandler Award, we will also be honoring Arnold and Porter attorney, Peta Gordon, with the Clarence Darrow Award, a recognition given to a member of the legal community who has made exceptional contributions to a cause for justice. The prestigious law firm Arnold and Porter was instrumental counsel to secure millions in essential school funding through the Delawareans for Educational Opportunity vs Carney. We'll be celebrating our honorees on Tuesday, October 15!     We're excited to announce our 2024 Kandler Award honorees, Dr. Ann Aviles and La Esperanza! Dr. Ann M. Aviles is an Associate Professor at the University of Delaware and Co-Chair of the HOMES Campaign DE, who advocates for educational access and equitable practices for marginalized students and families. La Esperanza has grown to become the second largest multi-service agency for Hispanic immigrants in Delaware, dedicated to serving Hispanic communities in Sussex County and surrounding areas. We'll be celebrating our honorees on Tuesday, October 15!     REQUEST FOR PROPOSALS ---- We're seeking applicants to pursue legal fellowships specifically, Skadden, Equal Justice Works, Justice Catalyst, Soros, school-based, and other fellowships for the 2025-26 term. The fellow will work on fundamental education equity rights and liberties, including public school funding, disparate disciplinary issues, and equal access to education for historically marginalized communities. Responsibilities include conducting investigations, both independently and in collaboration with the Legal Director, Dwayne Bensing, developing and advancing nonlitigation strategies in coordination with other departments, and serving as an ACLU-DE spokesperson with the media and external partners on identified issues.     Our policing and legal systems should keep communities safe, treat people fairly, and use fiscal resources wisely. From instances of police violence to systemic inequities produced by overly punitive sentencing laws and guidelines to the barriers to jobs, education, and housing posed by a record — the devastating consequences of our harsh, ineffective, and costly criminal justice system have fallen overwhelmingly on low-income people and Black and brown communities. Join us on Tuesday, August 6, from 12 - 1 p.m. for a virtual lunch event to hear the perspective of two expert sociologists sharing their research discoveries , approaches, findings, and recommendations for police reform. This event is moderated by ACLU-DE Smart Justice Ambassador, Crystal Chatman. Panelists include Professor Yasser Payne from the University of Delaware and Professor Jim Nolan from West Virginia University. Attorneys who attend are eligible for one hour of Continuing Legal Education credit. Amicus Society members receive free CLE credit for attendance.     The roadblocks pregnant people face today when deciding when, how, and if they want to be pregnant seem to close in by the day. But there has been a pushback: reproductive health ballot measures have overwhelmingly shown support for the rights of pregnant people in states across the political spectrum. Join us on Wednesday, July 17 from 12 - 1 p.m. for a virtual lunch event to learn more about and discuss the current state of reproductive rights across the nation and the ways it is impacting us in more than just the doctor’s office. This event will be moderated by Casey Danoff, ACLU of Delaware Penn Catalyst Legal Fellow. Panelists include Professor Serena Mayeri from the University of Pennsylvania’s Carey Law School and Ming-Qi Chu, ACLU Deputy Director of the Women's Rights Project.     UPDATE --- It is the end of legislative session in Delaware, and many important bills passed that should make us all proud, however, one major bill disappointingly did not pass: Senate Bill 4. This landmark legislation would have made significant changes to the probation system in Delaware. While the bill did not pass this session, there are many things that advocates can notch as significant victories for the probation reform movement. Probation reform is essential for public safety—keeping people out of prison supports their rehabilitation and successful reentry to our communities. Despite the setback of not passing probation reform in 2024, we are not backing down. Take action by thanking State Senator Marie Pinkney for shepherding probation reform through many difficult moments: https://lnkd.in/e2iHNbhh, by voting in upcoming elections, and by joining us soon to discuss next steps for the campaign.     • Update on Senate Bill 4: The fight for probation reform continues. This year lawmakers missed a critical opportunity to take steps toward repairing our broken probation system through Senate Bill 4 (SB 4), landmark legislation that would have made significant changes to the probation system in DE
    • Victories in the fight for probation reform: Over 420 people took action and contacted their legislator urging them to enact probation reform.  We conducted events in every county throughout Delaware, demonstrating statewide support for these critical reforms.  In April, we held a lobby day with advocates meeting directly with their elected officials, several of whom pledged their support as a result of those important conversations.  Our Smart Justice Ambassadors attended every event and legislative hearing to ensure that those with direct lived experience in the probation system were a part of the efforts to reform it.  Family members who support probation reform were able to lend their voices to this campaign, ensuring that our movement reflected a diversity of experiences.
    • Next steps in the fight for probation reform: Thank State Senator Marie Pinkney. As the prime sponsor of the bill, Sen. Pinkney shepherded probation reform through many difficult moments. We want to thank her, by encouraging you to fill out a thank you note here.  Vote. Vote. Vote. Does your elected official support probation reform? We’re going to be asking all candidates for legislative office their stance and publishing their answers on VoteDelaware.org. Use their answers to be certain you and your network vote for people who represent your values.  Join Us Soon.     • Looking ahead in the fight for probation reform. Delawareans deserve real justice reform, and we know that continued organizing, activism, and lobbying will deliver it. We will be back in legislative hall in 2025, continuing to push for these essential reforms. This is what social justice activism looks like: we lose, and build, and lose, and build, and keep that cycle going until one day we win.
