We are deeply disappointed by the court's decision. Our clients were the victims of horrific encampment sweeps, which took almost everything several of them owned. These sweeps upended their lives and put them in even more precarious situations. The ACLU of Minnesota filed an amicus brief calling upon the court to protect the rights of women, transgender, and gender nonconforming Minnesotans. Currently, Minnesota's indecent exposure statute is vague and effectively criminalizes the anatomy of half the population. Minnesota women can be arrested for and convicted of indecent exposure if some part of their breast is visible to the public because “female breasts” are “private parts.” The court of appeals doesn’t clarify what part of a breast can show and which can’t, so it’s uncertain what people with “female breasts” can wear to the beach this summer. “Male breasts” are not “private parts” so people with “male breasts” can’t be arrested for having part of their breasts visible. Our position is that treating people differently because of outdated ideas about gender and sexuality violates Minnesotans’ right to equal protection of the law. #EqualProtection #DueProcess #LegalNews #ACLU #GenderEquality https://lnkd.in/gHh5KTWK

The Mall of America recently launched facial recognition surveillance systems. MOA officials have stated they are relying on Corsight AI. Munira Mohamed, who is on ACLU-MN’s policy team, brings up important issues with systems like this: Facial recognition technology is often inaccurate — and people of color are more likely to be misidentified. Even if the technology was as accurate as MOA claims, the Mall of America boasts 40 million annual visitors. Misidentifying even a small percentage of those people would still mean thousands of wrongful identifications. Mall of America has decided to install facial recognition cameras on its premises. This raises critical civil liberties & civil rights concerns. ACLU-MN has continuously raised alarms on this type of technology & the threat it poses to individuals’ privacy rights & due process.
