Tom Wilding has been granted permission to appeal to the Court of Appeal from the Upper Tribunal in an appeal which will look at the meaning of (aaa) in the definition of Durable Partner in Appendix EU of the Immigration rules. In doing so the Court of Appeal will look for the first time at the pre-April 2023 rules and the meaning of (aaa). This will also allow the Court to consider whether the UT was correct on this point in Hani v Secretary of State for the Home Department Hani (EUSS durable partners: para. (aaa)) [2024] UKUT 68 (IAC). Tom is instructed by Alyssia Jones of AJ Jones Solicitors.

About a year ago, I realised that I should start thinking about probationary barrister tenancy/third six pupillage. It was a really scary prospect for me and I didn't feel that there were enough resources out there to explain, step-by-step, what I needed to do and when I should do it. Having successfully got to the other end I wrote this article for LexisNexis UK/Counsel for all those pupils who are thinking through difficult decisions about changing course at the moment.

Our team secured £34,000 in damages for our client who was unlawfully detained by the Home Office for 6 and a half months. The client was expertly represented by Solicitor Halima Begum, under the supervision of Director Gemma Lynch, of the Immigration team. The legal team also included Counsel Sandra Akinbolu and David Ball from the The 36 Group. Read more on this case here: https://buff.ly/3XXIAZG #immigration #duncanlewis #homeoffice

📢 Duncan Lewis is challenging the government in court over failures to raise legal aid rates for immigration and asylum work or take any other action to address problems in provision in a timely and effective way. This neglect has left vulnerable individuals struggling to find legal representation for crucial asylum cases, highlighting an urgent need for reform. Public Law Solicitor Jeremy Bloom says: "Legal aid will never be wildly profitable, and that’s ok. But providers of legal aid cannot continue taking on work that causes financial losses. It is not sustainable, and the losers are the people who need representation." The Duncan Lewis team involved in this judicial review include Toufique Hossain, Nina Kamp and Elizabeth Cole, who have instructed Matrix Chambers' Chris Buttler KC, Eleanor Mitchell and Jack Boswell.
