In order for "real" fairness in criminal justice, every aspect involved needs to be involved. It cannot just be a 1-sided issue. Prosecutors, defense attorneys, mental health advocates, and former criminal defendants should be able to collaborate about needed changes. When the system "is changed" from on high without any input from other sources, it leaves the system just as broken. Real change has to include all points of view, so that everyone's position is included otherwise it's just a dictatorship (do as I say) and that helps no one.

Policy must be established by a consensus of all stakeholders in the "Justice" system. The government influences almost all aspects of "Policy" that drives how defendants are investigated, indicted and prosecuted. The Justice System is so onerous that indigent folks are virtually without adequate/reasonable representation and their treatment by the "system" is fraught with unfair "policies" that result in disparity in treatment by the court.

I used to teach in male prisons. They are violent, dangerous drug riddled places where a large number of the inmates have serious mental health issues. Successive governments have done almost nothing for fear of being thought of as ‘soft on crime’. But treating people like animals doesn’t even begin to rehabilitate them and the tax payer ends up fronting the cost anyway.

I personally think that the guidelines are already established. The Bill of Rights already established that fairness is a guaranteed right. We just need SCOTUS to stop using political partisan ideas to interpret the Constitution. Common sense is obviously not a commodity of SCOTUS it appears. The problem is not in the fairness guarantees. The problem lies with the biased application and interpretations used by the judiciary.

I agree with Charles Oakley here. When I joined the staff of the Office of the Inspector General at the Los Angeles Police Commission there was a five point mission statement on the wall. Included in the values were transparency and protecting whistleblowers from retaliation. Yet on my very first case, the Inspector General gave sufficient information to her friend and the target of my inquiry that she was able to identify and retaliate against the whistleblower. The Mission Statement was subsequently removed from our wall and the complaint would be awarded $1.7 million in a lawsuit he filed against the city. Despite the retaliation he provided information on several cases that were subsequently swept under the rug by my superiors.

Generations taught youth how to choose friends and were vigilant about the company we kept. The standard must be resurrected. The conflicts of interest, circle of control, and impunity must be dealt with. The double standard the connected enjoy must also be removed. Enforcement of current laws must not remain at the discretion of the conflicted. Campaign reform could be a great place to start. Those who give to campaigns should all be identified, and Citizens United should be repealed in the interest of transparency. If the SCOTUS ruled that money has a voice, it must admit that wealth has domination and monopoly.

I work as a psychologist with youth in the school to prison pipeline and adults in prison or going to and coming out of prison. Their problems are often related to trauma, and insufficient Behavioral Health services for youth and families. Youth that have experiences severe early trauma may exhibit behavioral and learning problems. If we continue to treat them with disciplinary methods only and not provide other services, these youth will be in and out of the legal system until they and their families receive the services, they need. The legal system and the Behavioral Health systems should join as equal partners to treat the trauma, addictions and behavioral issues those in the legal system face.
