FCA US will not oppose Class Counsel’s petition for Attorneys’ Fees and Expenses up to and not exceeding this amount, and Class Counsel will not accept any amount for attorneys’ fees and expenses in excess of the above amount.
Counsel shall have the right to appeal the Court’s determination as to the amount of any Awarded Attorneys’ Fees and Expenses and of any Incentive Awards.
Any Class Member who has not filed a timely written request for exclusion and who wishes to object to the fairness, reasonableness, or adequacy of this Agreement or the proposed Settlement, the award of Attorneys’ Fees and Expenses or the individual awards to the Plaintiffs must deliver to Plaintiffs’ Class Counsel, Xxxxxxx’x Counsel, and FCA US’s Counsel and file with the Court on a date ordered by the Court a written statement of his or her objections.
The Court will determine the amount of Attorneys’ Fees and Expenses, as well as the amounts of Incentive Awards, consistent with the standards for similar settlements in the Ninth Circuit based on Class Counsel’s labor, risk, and the complexity of the work that was done to obtain the Settlement for the Settlement-Notice Class.
The purposes of the Fairness Hearing will be to consider the fairness, reasonableness and adequacy of the proposed Settlement and the application for an award of Attorneys’ Fees and Expenses, and to consider whether the Court should issue a Final Order and Judgment approving the Settlement, granting Class Counsel’s application for Attorneys’ Fees and Expenses, granting the Service Awards application by Settlement Class Representatives and dismissing the claims against the BMW Defendants with prejudice.
