Indiana man who attacked officers during Capitol riot on Jan. 6, 2021 heading to prison

WASHINGTON D.C. — An Indiana man has been ordered to spend over five years in prison after pleading guilty to assaulting law enforcement during the riots at the U.S. Capitol on Jan. 6, 2021.  

Tuesday, Curtis Logan Tate, of Jeffersonville, was ordered to spend 63 months in prison, followed by three years of supervised release for his felony charge of assaulting, resisting or impeding certain officers. U.S. District Judge Christopher Cooper also ordered Tate to pay $3,176 in restitution.  

According to a complaint detailing Tate’s involvement, the 32-year-old is seen on body camera footage that day entering the Lower West Terrace tunnel about 2 p.m. and striking an officer in the hand with a metal baton.

He posted a video on his Instagram account depicting the area, with a caption reading “Before the first breach,” a news release from the U.S. Department of Justice stated.  

An officer used pepper spray on Tate. Officials said he posted a second video of himself with a caption stating “Post 1st macing,” and he can be heard on the video yelling “we’re tearing this (expletive) down.”  

Nearly 45 minutes later, Tate entered the Tunnel with the metal baton over his head and is seen charging toward a line of police officers. He repeatedly struck a Capitol police officer in the helmet with a baton, court documents state. He was pepper sprayed again and he then retreated from the Tunnel.  

Tate returned to the Tunnel again and at 4:28 p.m., is seen picking up a black speaker box from the ground and threw it into an office window. The impact caused the window, which was already damaged, to crack even further.

He then threw a black speaker box at police officers protecting the tunnel, striking one in the arm.  

Court documents said Tate and other rioters then passed miscellaneous objects through the crowd to throw at police. Tate is seen throwing a broken table leg and floor lamp at an officer.  

He was arrested Aug. 24, 2023 in Wilmington, North Carolina.
