ORDINANCE NO. O-2024-XXXX

AN ORDINANCE GRANTING UTILITY EASEMENT TO BLACK HILLS ENERGY TO INSTALL AN UNDERGROUND GAS PIPELINE ON CITY OWNED PROPERTY AT THE DURANGO-LA PLATA COUNTY AIRPORT TO SERVICE THE AIRPORT AND DECLARING AN EFFECTIVE DATE.

WHEREAS, Black Hills Energy has requested the granting of a utility easement for purposes of providing gas utilities across City owned property to service the new Durango-La Plata County Airport terminal expansion; and
WHEREAS, Article II, §11(d) of the Charter of the City of Durango, Colorado requires the adoption of an ordinance to convey or lease or authorize the conveyance or lease of any real property owned by the City; and
WHEREAS, a public hearing has heretofore been held before the City Council of the City of Durango, and the Council has determined, subsequent to said public hearing, that the granting of the requested gas utility easement in favor of Black Hills Energy would be in the best interests of the citizens of the City of Durango;
NOW, THEREFORE, THE CITY OF DURANGO HEREBY ORDAINS:
Section 1. Subject to the approval by the City Manager of the terms and conditions of the Grant of Utility Easement and Agreement between the City of Durango and Black Hills Energy, the City Council of the City of Durango does hereby authorize and grant the utility easement in favor of Black Hills Energy for installing an underground gas pipeline, said easement being more particularly described and depicted on Exhibit ‘A’ hereto attached, the contents of which are incorporated by reference herein.
Section 2. This ordinance shall become effective ten (10) days after its passage and final publication as provided by law.

The request of funding from DOH is to benefit persons with low and moderate incomes by increasing the availability of affordable housing in La Plata, Montezuma, Archuleta, San Juan, and Dolores Counties in Southwest Colorado. Upper Pine River Fire Protection District

Upper Pine River Fire Protection District (Fire District) announces the opening of a sealed bid process for the purchase of property at 14427 CR 501, Bayfield CO 81122. The property is located at 14427 CR 501 BAYFIELD CO 81122, which is 0.18 acres and 7841 square foot area (Subject Property). The Subject Property has an old two bay fire station with the potential to
bring power into the building. The Subject Property may be suitable for a small shop or a tiny home. Current La Plata County regulations may not allow septic on this site. Interested parties shall perform their independent diligence and the Fire District does not represent that the property is suitable for any specific use. Inspection of the building is by appointment only and
those interested must call Upper Pine River Administration to arrange for an escort visit to the building. The Fire District will not pay any real estate broker fees or commissions. Sealed bids can be delivered to Upper Pine River Fire Protection District Administration Building at 515 Sower Drive between 8:00 a.m. and 5:00 p.m. M-F. until Friday August 16th at 4:00 p.m. The
Fire District has a lock box in the lobby of the fire administration building for deposit of sealed bids which will be deposited by the bidder into the lock box and the lock box sealed until opening of the bids.

In the event of no bids received by the closing date and time the property will continue to be held by the Upper Pine River Fire Protection District for further consideration.
