Rochester man dies after accidentally shot through floor, shooter charged

The man shot last week inside a northeast Rochester home was shot accidentally through the floor, according to police.

The slaying occurred around 12:15 a.m. Wednesday at 28 Rialto St., near Hollenbeck Street. Investigators determined that Marquell Miller, 25, of Rochester was carrying a rifle while on the second floor of his home when he accidentally pulled the trigger. One bullet went through the floor and struck Aaron Hurell, 24, who was walking on the first floor, in the head, said Capt. Greg Bello of the Rochester Police Department.

Officers arrived at the scene to find an seriously wounded Hurell on the front porch. He was taken to Strong Memorial Hospital, where he died on Saturday, Bello said.

Miller was charged with second-degree manslaughter, a felony, in connection with Hurell's death, Bello said.

The two men were acquaintances and Hurell was visiting the house when he was shot, Bello said.

Miller turned himself into police Monday afternoon. He is scheduled to be arraigned in City Court on Tuesday morning.

Rialto Street is a residential street in northeast Rochester, located near North Clinton Avenue. The block-long road was also the site of a triple shooting in May, when a man and woman were killed and a third person was seriously wounded.

Emergency responders were called to a home on Rialto Street, near Hollenbeck Street, around 12:15 a.m., where it was reported that someone had been shot, said Capt. Adam Radens of the Rochester Police Department. Officers found the injured man, who was shot at least once in his upper body while inside 28 Rialto St., said Rochester Police Capt. Frank Umbrino.
