Waivers

OIG has the authority to waive an individual's or entity's exclusion from participation in Federal health care programs.

An individual or entity excluded under sections 1128(a)(1), (a)(3) or (a)(4) of the Act may be eligible for a waiver only when the excluded individual or entity is the sole community physician or the sole source of essential specialized services in a community AND the exclusion would impose a hardship on beneficiaries (as defined in section 1128A(i)(5) of the Act) of that program. An individual or entity excluded under section 1128(a)(2) of the Act as a result of a conviction related to patient abuse or neglect is not eligible for a waiver. See 42 CFR 1001.1801(a)-(b).

For an individual or entity excluded under OIG's permissive exclusion authorities (section 1128(b) of the Act), a waiver may only be granted if OIG determines that imposition of the exclusion would not be in the public interest. See 42 CFR 1001.1801(c).

A waiver may only be requested by the administrator of a Federal health care program. Excluded individuals or entities may not request a waiver from OIG.

The current waivers in effect are listed below. Unless otherwise specified, all waivers permit the individual or entity to participate in Medicare, Medicaid and all other Federal health care programs, subject to the limitations described below and in each waiver letter. Please read the attached letters to obtain further details about the scope of each waiver.
