While the number of people claiming non-dom status in the UK rose 7.5% year on year between 2021/22 and 2022/23, the amount of tax paid remains below the 2017 high. The increase in numbers is likely due to the end of COVID-19 travel restrictions, but the lack of a corresponding rise in tax income suggests that while wealthier non-doms may be leaving the UK, their replacements might be less affluent. This could spell trouble for the government's plans to plug the public finance gap with extra tax takings from former non-doms after they abolish the status, according to Rachel de Souza of RSM UK. https://lnkd.in/eYMVq_y2

Five proposed amendments to Jersey trust law are under consultation by the Jersey government. The amendments cover: ✔️ priority of claims (as in Equity Trust v Halabi [2022] UKPC 36) ✔️ beneficiaries' power to call for the termination or variation of a trust ✔️ the situation where a sole trustee wishes to resign ✔️ 'pure data trusts', i.e. those where the assets are not property in the legal sense (e.g. cryptocurrency) ✔️ uncontroversial technical amendments. https://lnkd.in/eVJSutNS

📰 The US Supreme Court recently overturned the 40-year-old Chevron doctrine, which had required courts to defer to federal agencies on the interpretation of ambiguous laws. The IRS had long relied on this rule to defend tax regulations; however, in theory, this protection may now have been removed, and more rulings are expected. The IRS's power to issue tax guidance may also be constrained since rules will now have to go through the process of becoming a settled law. https://lnkd.in/eN7KhNyQ

📰 The pledges of the new UK Labour government are now widely expected to be put into action, including the adoption of the outgoing administration's planned abolishment of resident non-domiciled status and charging VAT on private school fees. The former policy is expected to enter the consultation phase in the next few weeks, with the new regime planned to be in place by April 2025.
