Montana's landmark youth climate decision is being appealed - what could this mean for climate litigation in the US and globally? Tom Cummins contributed to The Wall Street Journal's coverage of the Montana Supreme Court appeal. This case, which argues the state's failure to protect against climate impacts, is "part of a trend of judgments responding to the climate crisis", he says.
🌄 Last year a Montana state court struck down a law which prevented the state taking into account greenhouse gas emissions in environmental reviews. The court considered that the law was inconsistent with the right in the state constitution to a "clean and healthful environment". 🏛 Now the decision is going to appeal... 📰 I was pleased to contribute to the The Wall Street Journal's coverage of the appeal, particularly as they have placed this case in the broader context of international climate litigation, and a number of recent successes for claimants in climate litigations (see our briefing here: https://lnkd.in/g43HgMEh). #climatelitigation #esg #ashurst
