    Head of Telecommunications, Media & Technology Practice Group Chong Kin Lim 林宗勤 and Director Anastasia Su-Anne Chen are featured in the Asian Legal Business article titled, “Singapore ramps up national cybersecurity with expanded protection laws”, providing their perspectives on Singapore's recently expanded Cybersecurity Act (the “Act”). In addition to the amended Act, the planned introduction of the Digital Infrastructure Act in Singapore is intended to regulate digital infrastructures.     Director Eu-Yen Tay (郑尤妍) has been appointed as a member of the Intellectual Property Office of Singapore (IPOS), Copyright Tribunal for a three-year term from 1 July 2024.   The Copyright Tribunal is a forum for resolving licensing disputes between collective management organisations and users of copyright materials. The Tribunal is authorised to handle various aspects of copyright-related disputes and royalty determinations in Singapore such as resolving disputes concerning licenses and license schemes for works or other subject matter and determining royalties for the recording of musical works, including apportionment of royalties for records, among others.   Join us in congratulating her! #law #singapore

    The General Division of the High Court in HC/TA 1/2024 Outschool, Inc. v Allschools Pte Ltd upheld the decision of the Intellectual Property Office of Singapore to dismiss four consolidated opposition proceedings by Outschool Inc., concerning the trade mark applications for “ALLSCHOOL” by ALLSCHOOLS PTE LTD (“Respondent”) under Classes 9, 35, 41 and 42. This decision is a notable addition to the local jurisprudence of trade mark law as it is consistent with precedent cases that any instances of alleged actual confusion must be at the point of purchase, or the point of sale. It also spotlights the usefulness of relying on evidence relating to actual confusion. Managing Director of Intellectual Property Tony Yeo, Associate Director Kit Kuan Yuen and Associate Denise Thia acted for the Respondent and successfully defended the appeal.     Our Senior Associate Victor David Lau was invited to CNA938’s radio programme, Singapore Today, to share his insights on the Anti-Money Laundering and Other Matters Bill which will allow Singapore courts to order the sale of seized properties linked to suspected criminal activities and what this could mean for law enforcement agencies.   Victor explained that currently, a disposal inquiry may be convened for interested parties to lay their claim to the seized properties after a case is concluded.   Commenting on the recent $3 billion money laundering matter, he noted the unprecedented scale and value of the assets involved, which is likely to have prompted the introduction of the new Bill. Under the proposed law, the sale of seized properties could occur earlier if all parties consent.     Head of Financial Services Regulation, Grace Chong, recently shared her views on fintech innovation in an Asian Legal Business article on the significant developments and regulatory playbooks in the industry, particularly with the integration of artificial intelligence.   Grace shared her insights on the challenges and trends in the fintech industry amidst volatile market landscapes in Southeast Asia. Stressing various hurdles fintech startups face, she emphasised the importance of robust consumer protection frameworks, encompassing data privacy, transparency, and fair treatment, as essential for compliance.   She highlighted that “fintech companies must invest in advanced cybersecurity measures and develop comprehensive data management policies to meet stringent regulatory demands, which can be resource-intensive and complex to implement”.   Grace also noted the growing trend of digital tokenisation, particularly of real-world assets like real estate and art, which enhances liquidity and democratises access to high-value assets. She recognised the transformative impact of AI in fintech, being used for fraud detection, personalised services, and risk management and pointed out the need to address challenges related to data proliferation and ethical application.   Grace added that, “financial institutions also need to have robust contingency plans and clear accountability frameworks to ensure resilience and regulatory compliance”.   You may read the full article here: https://lnkd.in/e5jktWwg
