Justin Timberlake had ‘bloodshot’ eyes, insisted he drank only ‘one martini’ before DWI arrest: police

More details about Justin Timberlake’s arrest on DWI-related charges have emerged.

In the criminal complaint, obtained by Page Six Tuesday, the arresting officer of the Sag Harbor Village Police Department in New York allegedly observed Timberlake — who was driving a 2025 gray BMW — “fail to stop at a posted stop sign” and twice “fail to keep to the right side of the road.”

The officer then pulled the musician over, at which point “it was ascertained that [Timberlake] was operating said vehicle in an intoxicated condition, in that: his eyes were bloodshot and glassy, a strong odor of an alcoholic beverage was emanating from his breath, he was unable to divide attention, he had slowed speech, he was unsteady afoot, and he performed poorly on all standardized field sobriety tests.”

According to the officer, Timberlake, 43, also gave the “oral admission:” “I had one martini, and I followed my friends home.”

The former *NSYNC member was placed under arrest at 12:37 a.m. Tuesday and transported to Sag Harbor Police Headquarters “to be processed.”

He was charged with one count of driving while intoxicated and cited for two traffic violations: running a stop sign and failing to stay in his lane.

According to the complaint, Timberlake thrice refused to take a breathalyzer test.

“No, I’m not doing a chemical test,” he allegedly told officers at 12:52 a.m., going on to “refuse” the breathalyzer two more times.

Later Tuesday morning, the Grammy winner was photographed in handcuffs being led from the police station to the neighboring Sag Harbor Village Justice Court, where he was arraigned and released without bail.

Timberlake looked downcast in a black shirt over a gray graphic tee, light-wash jeans and white Nike Air Force 1 sneakers — with attorney Edward Burke Jr. by his side.

It’s unknown whether his wife, Jessica Biel — with whom he shares two sons — was at dinner with the group, as she was seen filming the TV series “The Better Sister” in Manhattan earlier Monday.

Our source noted that Timberlake’s “friends were telling the police, ‘Let him go, let him go;'” however, the arresting officer “was so young that he didn’t even know” who the pop star was.

A second source added that “Justin said under his breath, ‘This is going to ruin the tour.’ The cop replied, ‘What tour?’ Justin said, ‘The world tour.'”

Alcohol- and drug-related violations in New York include DWI (driving while intoxicated), which indicates a blood alcohol content of .08 or higher, and DWAI (driving while ability impaired), which is a BAC of more than .05 but less than .07. The state does not use the term DUI (driving under the influence).

Timberlake’s next court date has been scheduled for July 26.
