Harvey Weinstein is not getting out of prison on $2M bail pending appeal

Harvey Weinstein will not be released from prison on $2 million bail pending an appeal of his Manhattan rape conviction, sources told The Post.

Appellate Division First Department Judge Angela Mazzarelli issued a decision Monday denying the defense’s bail request.

The former powerhouse producer’s lawyers had argued last Friday that he would likely die if he remains in prison due to a multitude of serious health conditions — including diabetic retinopathy, coronary artery disease and spinal stenosis.

Prosecutors countered that if Weinstein were released, he would have “every incentive to flee” and the resources to do so.

His attorneys have yet to file his appeal, which centers on the seating of a juror who they claim repeatedly lied to the trial court about a novel she wrote featuring predatory older men and underage girls.

Weinstein is serving a 23-year-sentence at Wende Correctional Facility east of Buffalo after he was convicted by a Manhattan jury of forcibly performing oral sex on former “Project Runway” production assistant Miriam “Mimi” Haleyi and raping hairstylist Jessica Mann.

He faces a separate sex-crimes case in Los Angeles, where he’s charged with 11 counts of rape, sexual battery, and other raps stemming from the allegations of five women.
