You can hail the queen of rap — but you apparently can’t serve her.
A lawyer representing a fan who sued hip-hop star Cardi B over a scuffle with bodyguards, claimed Thursday in court papers that he’s not been able to hand the rapper the legal papers necessary to advance the civil action.
“Diligent attempts to locate Cardi B … have so far been fruitless and the parties’ dedication to avoiding responsibility for their actions has made it impossible for plaintiffs to serve them within the 120-day limit,” attorney Daniel Szalkiewicz claimed. “New York courts have broad discretion to grant an extension of time to serve the summons … here plaintiff can establish `good cause’ for an extension of time and that doing so is in the `interest of justice.’”
Szalkiewicz’s client, autograph seeker Giovanni Arnold, said he was outside the Mark Hotel on the Upper East Side on May 8 when hired muscle of Cardi B and her husband, fellow rapper Offset, beat him up.
Szalkiewicz filed Arnold’s lawsuit on May 16, opening a 120-day window to serve papers on Cardi B and Offset. The plaintiffs said they served papers to Offset while he was in his SUV on Aug. 12 — though he tossed them out the window as soon as he got them.
But Cardi B, who suffered a nasty shiner from a Fashion Week brawl with her rival rap queen, Nicki Minaj, this past Friday, has proven more elusive, according to Szalkiewicz.
