Kelly Rutherford wins temporary custody of kids after bitter, 6-year battle

After a six-year battle, “Gossip Girl” star Kelly Rutherford has been granted temporary custody of her two children, who have been living in France and Monaco with their father since 2012.

Little Hermes, 8, and his sister Helena, 6, have been caught in the middle of a bitter custody battle since Rutherford and Daniel Giersch split up in 2009.

Rutherford, 46, filed for divorce when she was three months pregnant with Helena.

A court order filed Friday said the children must return to Los Angeles, and that their mother will keep their passports. People magazine first reported the deal Sunday.

Rutherford had told People that Giersch would not allow her to see the kids after she arrived in France for her latest trip last week unless she gave their US passports to someone his legal team called “a neutral person.”

Rutherford said the neutral person was one of his attorneys.

It was not immediately clear if Monaco would abide by the California judge’s ruling.

Rutherford recently rallied her celebrity pals, including Ed Westwick, Matthew Settle, and Kris Jenner, who gave their support on social media.
