IOC Fan Engagement Initiatives - Privacy Notice

This privacy notice (“notice”) explains how we (the International Olympic Committee (“IOC”)) collect and further process your personal data, as well as who we share that data with, when you take part in our fan engagement initiatives. In particular, fan engagement initiatives that involve a prize promotion (which may include user surveys).

What information do we collect?

We collect information that you provide to us when participating in a prize promotion, including your name, your contact details (i.e. email), place of residence (including postal address if necessary to fulfil a prize) and, where applicable, your responses to our user surveys, which include without limitation information about your interests and characteristics. We also collect your contact details, image, likeness, voice and/or endorsement where you take part in activities such as photoshoots, filming and the IOC’s production of other materials in connection with the prize promotion.

We deploy cookies and similar technologies to collect certain data when you interact with the platform on which this prize promotion is hosted. Our cookie policy provides more information about our use of these technologies, and how you can manage your consent to them.

How do we use the information we collect?

We use the information that you provide:

a) to facilitate your participation in, and to administer, the prize promotion;

b) if you are winner and in accordance with the terms of the prize promotion:

i. for prize fulfilment purposes;

ii. to make public or otherwise disclose to others that you have won a prize; and

iii. for the purpose of promoting the IOC, Olympic Movement, the prize promotion and other Olympics-related initiatives/activities;

c) to send you promotional communications (i.e. email updates and offers related to the Olympic Games and Olympic marketing partners) where you have consented to receive them;

d) where you complete a user survey:

i. for profiling purposes, so that we can: better understand Olympics fans; organise Olympics fans into groups that share similar interests and characteristics; and, use those groups to build audiences and target them (such audiences may include you and people who share a similar profile to you) with more relevant content and advertising;

ii. to send you promotional communications (i.e. updates and offers by email) that are not generalised but more relevant to your interests and characteristics (to the extent you have consented to receive promotional communications).

We may also combine your personal data with other information that we already hold about you or that we acquire through different initiatives. For example, where we have collected data from similar campaigns or from other organisations. Such other organisations are members of the Olympic Movement or entities that run Olympic-themed digital services or feature Olympic Properties within their digital services, and have informed their users that they will share data with us for our profiling and / or marketing purposes; and

iii.to fulfil your direction to share data with third parties, such as our marketing partners. See ‘Who do we share your information with?, below.

Who do we share your information with?

Partners

Where our prize promotion is sponsored by our marketing partner(s) we shall, with your consent, share the information that we collect from you as part of the promotion with such partner(s). In particular, your name, email, place of residence and, where completed, your answers to the user survey. We may also disclose to the marketing partner(s) our record of your consent to such sharing of data with them. Our marketing partner(s) shall use this data (each as an independent controller) for their own profiling and / or marketing purposes, to enable them to build campaign audiences and deliver targeted content and advertising based on your interests and characteristics. Our marketing partner(s) may also combine the information we provide to them with information they already hold about you. Organising Committees for the Olympic and Paralympic Games

An Organising Committee for the Olympic and Pafralympic Games (“OCOG”) is responsible for organising an edition of the Olympic Games and Paralympic Games. Each OCOG is based in the territory in which its respective Olympic and Paralympic Games shall be hosted.

The prize promotion may feature a means by which you consent to receive promotional communications from one or more OCOGs. Where you consent, the IOC will share your personal data (including your email and a record of such consent) with the relevant OCOG(s).

The OCOG(s) (each as an independent controller) use this data to send you promotional communications, including marketing related to their products, services and partners.

Service Providers

We rely on a network of service providers that process personal data on our behalf. They provide services that help us to operate, develop, secure, promote and measure the prize promotions, as well as services that enable us to further use personal data in the ways described in this notice. Such services are: (i) the provision of technologies that support (a) our online collection, storage and use of data in connection with the prize promotion, (b) our marketing activities, and (c) our management of user consents and other data protection-related rights; (ii) prize promotion administration and prize fulfilment services, and (iii) analytics, audience and advertising measurement services. See Annex 1 to this notice for a list of our main service providers.

Legal Disclosure

We reserve the right to disclose personal data we hold about you if we are required to do so under applicable laws or pursuant to any judicial or administrative process and, to the extent necessary, to investigate, prevent, or take actions in relation to unlawful activities or a violation of the terms of the prize promotion.

Marketing activities connected to our promoting the IOC, Olympic Movement, the prize promotion and other Olympics-related initiatives/activities:

 

      • Where you take part in activities such as photoshoots, filming and the IOC’s production of other materials in connection with the prize promotion, and any subsequent photograph, audio-visual production or any other form of media comprises your personal data.

 

      • Where we use your personal data for the purposes of profiling, tailoring promotional communications, and combining your personal data with other information we may already hold about you or acquire through different initiatives, as described in the section ‘How do we use the information we collect’, above.

Our legitimate interest to promote the Olympic Movement and  protect its legacy, and to better understand and find ways to develop our relationship with, and to reach our, existing and potential fans.

 

You have a right to object to this processing by (i) contacting us using our IOC dedicated portal; or (ii) writing to us at the address stated at the start of this privacy notice.

International transfers

We may process your personal data in a territory other than your place of residence. We adopt measures as required under applicable law to ensure your data will be given the relevant level of data protection.

The personal data we collect will usually be processed in the European Union, UK or in Switzerland. The UK and Switzerland provide a level of data protection essentially equivalent to that which exists within the European Union according to the European Commission.

We may, however, transfer your personal data to third parties for the purposes, and on the legal bases, of processing highlighted in this notice (see the section above ‘Who do we share your information with?’). Some of these third parties may be based in countries that do not provide in their laws for a level of data protection essentially equivalent to that applied within the European Union, UK and Switzerland. Where you consent to us sharing your personal data with marketing partner(s) for their marketing or profiling purposes, we will provide you with their privacy notice as part of the consent. We adopt measures as required under applicable law to ensure your data will be given the relevant protection.

Before transferring data from Switzerland, the UK or the European Union to other countries, we implement safeguard mechanisms recognised by Swiss and European regulators, in particular standard contractual clauses (or the local required equivalent).

To the extent provided by the applicable law, you have a right to contact us for more information about the safeguards we put in place to provide adequate protection of your personal data when it is transferred as described above.

Data retention

We will retain your personal data only for the duration necessary for the purposes identified in this notice. How long we keep your personal data varies and may depend on criteria that include:

  • the date of your last interaction with us;
  • whether retention is necessary or advisable due to applicable statutes of limitations, litigation, or other legal, regulatory, accounting or reporting obligations; or
  • any relevant retention requirements under applicable laws or in agreements with you or others.

Age limitation

Users who are not of legal age for data protection purposes or for the purposes of receiving our services (according to the laws of the territory in which they reside) must obtain the consent of their parent or legal guardian before using our services and the IOC reserves the right to request proof of such consent and/or of the age of the user at any time in case of any doubt. Your rights and how to exercise them

Your rights

You can exercise your rights of access to, rectification, deletion and portability of, your personal data, limitation and objection to its processing, as well as your right to not be the subject of decisions based solely on the automated processing of your personal data, where appropriate, before us. You also have the right to withdraw your consent at any given moment. We may require evidence of your identity before we are able to respond to your request. If you live outside the European Union or UK, you may also have rights under applicable laws in such jurisdiction. Please contact us via the means described below if you have any questions in connection with exercising your rights. We reserve the right to decline a request where the legal conditions are met and in particular where the request made to us is manifestly unfounded or excessive.

Referral to supervisory authority

In cases where the European Union General Data Protection Regulation (“GDPR”) applies, you have the right to lodge a complaint with a European Union supervisory authority, in particular, in the territory where you live, place of work or place of the alleged infringement.

Where the UK General Data Protection Regulation applies, you have the right to lodge a complaint with the UK’s Information Commissioner’s Office.

Where Switzerland’s Federal Act on Data Protection of 25 September 2020 applies, you have the right to refer the matter to the Federal Data Protection and Information Commissioner in Bern, Switzerland.

Changes to this notice

When we make changes to this notice, we will revise the “last updated” date below and the changes will be effective immediately upon posting. We will inform you in advance where such changes impact your rights as a participant in one of our prize promotions or where required by law, for example by posting a notice in connection with the prize promotion or by sending you an email communication, so you can review our revised notice and decide whether to continue to take part in the prize promotion or not. Your continued participation in the prize promotion following the posting of the changes will constitute your acceptance of such changes unless you exercise your rights as described in this notice.
