Assistant district attorney resigns after appearing ‘visibly intoxicated’ in Mississippi court

An assistant district attorney from Mississippi was charged with contempt of court after he appeared “visibly intoxicated” in the courtroom and made incoherent arguments, authorities said.

Desoto County Assistant District Attorney Thomas Waller, 56, was arrested around 5 p.m. on Thursday, according to documents obtained by WREG.

He resigned from his post on Friday.

“As of this morning, I have accepted the resignation of Mr. Waller, effective immediately,” DeSoto County District Attorney Matthew Barton said. “This is a regrettable situation that does not reflect the high standards for performance that are expected of this office.  

“And while I cannot comment on the physical, emotional, or mental health of a former employee, I do hope he receives the support he needs for his well-being during this difficult time,” Barton added.

Waller was “visibly intoxicated” in the courtroom and allegedly had a strong odor of alcohol on his breath, according to court court documents.

He allegedly made incoherent arguments that impeded the conduct of court business.

He was released from the DeSoto County jail around 1 a.m. Friday morning.
