‘Drunk’ Texas man arrested for having 13-year-old drive him for ice cream

A drunk Texas man allegedly enlisted his 13-year-old stepdaughter to drive him to get ice cream, according to authorities.

Javier Martinez-Aguilar, 42, of Lubbock, was charged Tuesday with endangering a child and criminal negligence in connection to his stepdaughter’s joy ride, news station KAMC reported.

Police said they pulled over the pair Sept. 9 for failing to yield for their squad car, after the two vehicles nearly crashed.

The officer walked up to the girl behind the wheel and asked for a license, but she said she didn’t have one, the Fort Worth Star-Telegram reported.

When the cop asked how old she was, she allegedly replied that she was 13-years-old was “driving her stepfather to get ice cream because he was drunk,” police said

Martinez-Aguilar, who was in the passenger seat, also told the officer that “they had just gone out to get some ice cream,” authorities said.

The officer said Martinez-Aguilar reeked of alcohol and struggled to get out his license from his wallet.

When the cop tried to arrest him, Martinez-Aguilar “swayed and turned multiple times making it difficult to place him in handcuffs,” police said.

He was taken to Lubbock County detention center, while the girl’s sister came to give her a ride home, KAMC reported.
