Woman who left husband to rot can return to apartment: judge

The Upper East Side real estate agent charged with leaving her longtime companion helplessly lying in his own filth with festering sores for more than a week will be permitted to return to her apartment.

Lynne Roberts, 68, was barred from the pad she shared with Peter Locker, 67, after he was discovered March 15 face down on the floor “barely conscious and covered in feces, urine and vomit,” according to the complaint.

The Douglas Elliman agent allegedly waited eight days to call 911 after Locker fell and couldn’t get up, court papers allege.

Assistant District Attorney Meredith Dempsey said she consented to Roberts’ request to return because Locker, who has been in the hospital since the incident, will be transferred to a long-term assisted living facility.

Judge Josh Hanshaft signed off but warned Roberts not to have any contact with Locker who has a restraining order against her.

Roberts is charged with first-degree endangering the welfare of an incompetent or disabled person, which carries up to seven years in prison.

Defense lawyer Roger Stavis said they would fight the case.
