Ex-gal pal set to grill Sumner Redstone

One of the two women accused of fleecing billionaire Sumner Redstone out of $150 million struck back Thursday by issuing a deposition notice to the 93-year-old media mogul.

The notice calls for Manuela Herzer — who was named in an elder-abuse suit on Tuesday — and her legal eagles to depose Redstone on Nov. 8, Election Day, at his $20 million Beverly Hills estate.

Herzer will be present at the deposition, according to her lawyer, Ronald Richards.

So will an expert to evaluate Redstone’s lack of capacity and cognitive dysfunction, Richards said.

Herzer contends all gifts she received from Redstone were made with his full knowledge and blessing. She also claims the suit is really the handiwork of his daughter, Shari Redstone, who with her father control both CBS and Viacom.

“Mr. Redstone does not get a bye because he is rich or special,” Richards told The Post. “The deposition will expose the theater his daughter Shari Redstone is engaging in at his expense.”

Herzer began dating Redstone in 1999 and re-appeared in his life as a close friend and confidant in 2009.

She moved into his mansion in 2013, having been invited to do so by Sydney Holland, Redstone’s girlfriend and housemate at the time.

Herzer and Holland are both defendants in the elder-abuse suit, which names Sumner Redstone as the plaintiff and seeks to claw back the $150 million allegedly obtained by preying on his physical frailty and diminishing mental capacity.

Herzer’s deposition request exploits an unusual California law that requires plaintiffs to sit for deposition within ten days of notice. Most states require at least 20 days before discovery can take place.The state also has a 20-day hold before discovery by plaintiffs can take place.

The law also entitles the defendant to seven hours of deposition time. Herzer plans to “use every minute of it,” Richards said.
