DA must move 50 cases because new deputy was lawyer for some defendants

The new No. 2 in the Staten Island District Attorney’s Office has gone from keeping people out of jail to locking them away, and that is not sitting well with some law-enforcement types.

Newly sworn-in DA Michael McMahon, who just hired Paul Capofari, is planning to transfer 50 criminal cases to other jurisdictions because Capofari represented some of the defendants.

“It puts a bad taste in cops’ mouths because we wonder, ‘Which side is he on?’ ” a law-enforcement source said.

Capofari did not return a call seeking comment, but he has withdrawn from cases in which he was a defense lawyer, a DA spokesman said.
