Suspended jail guard should not be allowed to keep gun: wife

A Long Island woman shot in the face by her jail- guard husband blames the city for letting him keep his gun after he was suspended for abusing an inmate, according to a lawsuit.

Rikers Island Capt. Brian Martin, 36, allegedly shot his wife, Janine, during a December argument inside their Roosevelt home. He was charged with attempted murder.

Janine Martin says in the Manhattan Supreme Court suit that her husband was suspended from his job at the time because “he excessively, physically abused an inmate on Nov. 23.”

The city and the Correction Department were reckless and careless for allowing Martin to retain the gun “without medical or psychiatric evaluation,” she says in her legal claim.

She is suing the city for unspecified damages.

The city said it would review the claim.
