COURT-ING A DISASTER

THE ISSUE: The unpredictable voting record of Supreme Court Justice Anthony Kennedy.

In his article, “The High Court’s Supreme Clown,” (PostOpinion, July 1) Rich Lowry exposes Supreme Court Justice Anthony Kennedy as someone who is more concerned about his own personal opinions and beliefs.

Kennedy once again shows more concern for the criminal in his ruling that Louisiana’s death penalty for those who rape a child is “cruel and unusual punishment.”

Being at the mercy of Kennedy’s decisions, America is experiencing cruel and unusual punishment.

Lowry’s portrayal of Kennedy as the “worst justice ever” brings to the forefront what could possibly be the single most important issue in the presidential election: the appointment of new Supreme Court justices.

The next president could be the deciding factor in whether the United States of America goes far to the left with Barack Obama or stays more traditional and conservative with John McCain.

I concur with Lowry: Kennedy is the least consistent and, by definition, least competent justice on the bench.

His decisions have been personal opinions rather than interpretations of the Constitution.

Kennedy was President Reagan’s third choice. Congress rejected Robert Bork after the character assassination by Sen. Ted Kennedy, and Douglas Ginsburg withdrew his name from consideration. With time running out, Kennedy was the only choice left.
