A cop whose NYPD career went up in smoke after his wife allegedly spiked his meatballs with marijuana is suing to get his job back.

In papers filed in Manhattan Supreme Court, Anthony Chiofalo says Commissioner Ray Kelly’s decision to end his 22-year career was “arbitrary, capricious, unreasonable and unconstitutional.”

Chiofalo had spent three years on the elite Joint Terrorist Task Force when he failed a random drug test in 2005.

The suit says he thought the positive reefer finding was madness because he didn’t smoke pot.

But he said his wife, Catherine, often smoked grass to ease her back pain, and at first guessed that it might have been from secondhand smoke.

When investigators interviewed Catherine, she made a stunning admission – she said she’d twice spiked the meatballs she was serving her husband for dinner with about six joints worth of marijuana.

She said she’d been upset with him for not retiring after serving 20 years, as he originally said he would.

Both husband and wife passed lie-detector tests confirming their stories.
