FURY AS JUDGE STAYS CONFINED

Supporters of a former Brooklyn judge who has been confined to a nursing home against his will fumed yesterday after the jurist hearing the case put off a decision for a month.

“Even criminals who are convicted of felonies, after time served, they’re released,” said the Rev. Samuel Boykin, a nephew of 82-year-old Judge John Phillips. “It’s not like he’s some kind of serial killer.”

Boykin and Symphonie Moss, the judge’s niece, are each asking the court to release Phillips from a Bronx nursing home.

Both relatives submitted plans for Phillips’ care, but Justice Michael Pesce put off a decision after noting that Moss’ petition hadn’t been properly filed.
