To further strengthen its position in the European lubricants market, Telko has acquired the industrial lubricants distribution businesses of Optimol in the Netherlands, Belgium, Luxembourg and France. Na een lang wetgevingsproces en politiek getouwtrek van ruim drie jaar, is vandaag de definitieve tekst van de AI Act gepubliceerd. Deze wet stelt eisen en verplichtingen aan het gebruik van kunstmatige intelligentie (AI) om betrouwbare AI te waarborgen zonder innovatie en technologische vooruitgang onnodig te belemmeren. De AI Act richt zich voornamelijk op AI-systemen met hogere risico’s en hanteert een risicogebaseerde benadering. Hierbij wordt onderscheid gemaakt tussen AI-toepassingen die een (i) onaanvaardbaar risico, (ii) hoog risico, of (iii) laag of minimaal risico met zich meebrengen. Voor AI-systemen met een hoog risico gelden strengere eisen dan voor die met een laag of minimaal risico. AI-systemen met een onaanvaardbaar risico zijn verboden. 𝗚𝗲𝗳𝗮𝘀𝗲𝗲𝗿𝗱𝗲 𝗶𝗻𝘃𝗼𝗲𝗿𝗶𝗻𝗴 𝘃𝗮𝗻 𝗱𝗲 𝗔𝗜 𝗔𝗰𝘁 De invoering van de AI Act gebeurt stapsgewijs. De wet treedt over 20 dagen in werking, waarbij de meeste bepalingen na een implementatieperiode van twee jaar van kracht worden. Het verbod op AI-systemen met een onaanvaardbaar risico geldt echter al na zes maanden. Een voorbeeld hiervan is het creëren van gezichtsherkenningsdatabases. Dergelijke systemen moeten binnen een half jaar van de markt worden gehaald, waardoor het nu al van belang is om in kaart te brengen welke AI-systemen binnen organisaties worden gebruikt. De regels en verplichtingen voor 'general purpose AI models', zoals ChatGPT, gelden na één jaar. Voor AI-systemen met een hoog risico (bijvoorbeeld tools voor onderwijsdoeleinden en HR-processen) en AI-systemen die in gereguleerde producten zijn ingebouwd, zijn de regels na drie jaar van toepassing. 𝗧𝗼𝗲𝘇𝗶𝗰𝗵𝘁 𝗲𝗻 𝗵𝗮𝗻𝗱𝗵𝗮𝘃𝗶𝗻𝗴 Op nationaal niveau zal onder andere de Autoriteit Persoonsgegevens toezien op de naleving van de AI Act, hoewel de precieze vorm van toezicht in Nederland nog moet worden vastgesteld. Niet-naleving kan leiden tot aanzienlijke boetes tot 6% van de wereldwijde omzet, met proportionele sancties voor startups en kleine en middelgrote ondernemingen.
