Hunter Biden withdrawls request for new gun trial

Hunter Biden sought to have the case retried for a jurisdiction issue.

Hunter Biden has withdrawn his request for a new gun trial, according to court filings Tuesday. 

The first son was found guilty in June on three federal felony gun charges.

Biden and his legal team filed the request on the argument District Judge Maryellen Noreika, for the District of Delaware, didn't have the jurisdictional authority to preside over the trial because of a pending appeal to a higher court. 

But in the new motion, filed Tuesday, Biden's lawyers acknowledged they misunderstood the situation, CNN reported.

In the trial last month, a jury found him guilty of lying on a federal background check form that he was not using drugs at the time that he purchased a gun in 2018. Biden is still appealing the guilty verdicts to higher courts.
