Greater Noida builder ordered to compensate buyer for 3-year delay in handover, incomplete construction

The National Consumer Disputes Redressal Commission has directed Panchsheel Buildtech in Greater Noida to compensate the homebuyer in the form of 6% annual interest on their deposit.

Over a decade ago, in 2012, a homebuyer booked a flat for Rs 70 lakh at Panchsheel Greens in sector 16, Greater Noida. If things went as planned, the buyer would have got the flat by 2017, three years after the layout plan was approved. In 2021, they were asked by the builders to take possession of an incomplete house, which they refused.

The National Consumer Disputes Redressal Commission (NCDRC) recently directed Panchsheel Buildtech to compensate the homebuyer for the three-year (2017 to 2020) delay in the form of 6 per cent annual interest on their deposit. The commission further directed the builder to complete the construction and hand over the flat without any delay.

The builder said that due to a farmer agitation, the master plan was notified late, leading to a delay of two years from 2012 to 2014. Though it offered possession to the homebuyer in 2017, an occupation certificate was not yet issued, due to which the complainant refused to take possession. After a four year delay, the occupation certificate was issued and possession was offered to the buyer in 2021.

On being offered possession for the second time, Reena Rao, one of the complainants in this case, alleged that the house was not habitable. She complained that the entry gate was missing, the house was “totally raw” and that there was a lot of seepage in the house. It was also her complaint that woodwork, bathroom fittings, and kitchen work were incomplete and that the walls of the house were not aligned with one another.

“Your offer of possession is farce and false to what you were supposed to deliver,” Rao wrote to the builder.

The complainants also alleged that the price of the flat was increased from Rs 55.7 lakh to Rs 70 lakh allegedly following an Allahabad High Court order enhancing the compensation to be given to farmers in case of land acquisition.

Alleging that money from the project was “siphoned off”, the buyers pointed to the other projects started by the builder without finishing the current one—Pratishtha, Pebbles, Pinnacle, Premium 24, Prime 90 and Wellington 2 Towers.
