The Karnataka High Court has rejected the application of a Chinese citizen, accused in the Power Bank loan app scam, to leave the country to visit her ailing father. The order was issued on July 5 by Justice Nagaprasanna, in response to a petition filed by the accused, Hu Xiaolin.
The scam allegedly worked by promising investors high returns on their investments if they deposited money into the Power Bank app.
She had previously obtained bail on condition that she could not leave the area of jurisdiction of the court.
Xiaolin’s counsel argued that the Kerala High Court had permitted her to visit China and return with regard to the cases registered in their jurisdiction. It was argued that if the permission was not granted, then Xiaolin would lose the chance to be with her 80-year-old father in his last days.
The opposing counsel argued that there were seven different cases registered against the petitioner and her husband in the Power Bank scam, and it would be impossible to make her return from China.
The bench observed that the prevailing laws in China prohibited exit of a foreign national from the country under these circumstances, and thus similarly the laws of India could not be made flexible in such a matter.
The bench stated, ” ….if petitioner is permitted to move out of the shores of the nation, despite the plethora of crimes pending against her, it would become impossible to conclude trial, as it would be permitting her to flee justice and create a dent in the majesty of law….Therefore, seeking permission to travel abroad does not merit any consideration in the peculiar facts of this case.”
The petition was then rejected.
